Judicial system not captured – Ziyambi

Justice Legal and Parliamentary Affairs Minister, Ziyambi Ziyambi has rubbished claims that Zimbabwe’s judiciary is captured.

Speaking this morning, after the swearing in of a tribunal chaired by retired judge Justice Simbi Mubako to inquire the fitness of Justice Erica Ndewere to hold the office of a High Court Judge, the minister said the rule of law is being followed.

“The swearing in of the tribunal is a very good sign. It shows that our system is working,” said Minister Ziyambi.

“I believe that once the President is informed by the Judicial Services Commission (JSC) and they have clearly detailed the reasons for their recommendation, the due process of the law should be followed and this is what the President has done.

“This is very good for our judicial system. It allows everyone to abide by the constitution.”

Minister Ziyambi reiterated that Justice Ndewere stands innocent until proven otherwise by the tribunal.

The JSC recommended a tribunal to investigate whether or not Justice Ndewere was fit to hold office after allegedly discovering she was not clearing her workload in reasonable time and that she had not properly studied the file on a thief’s conviction and sentence when she set aside a jail term.

There is no suggestion of improper conduct in the commission’s recommendation, just that the judge is not up to the standard expected by not reading files properly and delaying matters way beyond permitted limits.
