Marry Mubaiwa hearing postponed

Zimbabwe’s High Court has postponed the hearing in which the embattled wife of the country’s Acting President is seeking access to the couple’s children and matrimonial home.

Marry Mubaiwa – the estranged wife of Acting President Constantino Chiwenga – filed an urgent application this week accusing her husband of denying her access to the children and the properties.

The case is now set to be heard on Tuesday.

High Court Judge, Justice Christopher Dube-Banda will hear the case in which Mubaiwa is praying that the court compels Acting President Chiwenga to release the children into her custody as well as allow her access to the matrimonial home while their divorce is being finalised.

Acting President Chiwenga, on the other hand, argues that there is medical evidence suggesting that Mubaiwa is unfit to take custody of the children.

“The doctor concluded that she (Marry) should be under the care of a physician, a surgeon and a psychiatrist.

“It is indicated that she has flashbacks, suffers from lack of sleep and has difficulties in breathing, symptoms of illicit drug abuse.

“Applicant cannot be trusted with children in the circumstances. While she cannot be precluded from being with and seeing the children, the court must balance the scales as there is need for both parents to continuously be with the children in order to ensure an unabused welfare,” he said in opposing affidavits.
