The hearing of Marry Mubaiwa’s application to have her passport released, to enable her to seek treatment in South Africa for a skin ailment has been rolled over to tomorrow, after the respondent team represented by Sharon Fero failed to file in their response.
Mubaiwa’s lawyer Beatrice Mtetwa said the respondent team had requested for an extension of time to be able to file in their response.
“The state says that it requires time to respond to the application, and that they would have filed their response by the end of day today, and the matter has been postponed to tomorrow,” said Mtetwa.
Fero however told the court that the response would be ready and submitted by end of day today for the matter to be heard tomorrow.
Justice Benjamin Chikowero agreed to postpone the matter to tomorrow.
Mubaiwa was ordered to surrender her passport early this year as part of her bail conditions which also included reporting to the police on Friday once a fortnight between 6am and 6pm. She is accused of assaulting the family maid, Delight Munyoro, at Hellenic School in Borrowdale following an altercation over the custody of her children.
